What is the Car Insurance Company's Agenda?

The purpose of an insurance company is to protect their insured. So when you are hit by another driver, his insurance company is trying to protect him. It is also trying to protect its profit margin. Despite the fact that the insurance companies, like everyone else, sustained heavy losses in the stock market, they continue to show profits. Insurance companies have made up for their losses by not paying claims. So don't expect the other driver's insurance company to be helpful to you. The adjuster isn't going to advise you as to what is fair. It will try to settle with you for as little as possible. You are the person who decides what little you will take.

What are the different types of Automobile Insurance?

Alaska law requires all drivers to carry liability in the minimum amount of $50,000/$100,000 limits. The purpose of liability insurance is to protect the driver and his assets in the event that he is found liable for causing an accident. You may also purchase:

Medical payments Benefits. The minimum limit sold is $5,000. Medical Payment Benefits will pay the medical bills of the passenger and driver in your vehicle.

Uninsured/Under-insured Motorists Benefits. This coverage protects you when the at-fault driver has no insurance or is under-insured. Limits are a maximum of $1,000,000/$2,000,000.

Comprehensive/Collision. Comprehensive and collision pay for the damage to your vehicle.

Gap Insurance. Gap insurance will pay off the loan of your vehicle if, when it is totaled, you owe more than the fair market value.

If I’m injured at work, can I sue? 

Maybe.  As a general rule, you cannot sue your employer or coemployee for their negligence that caused your injuries.  But there may be other responsible parties who you can sue so it is important to contact an attorney to thoroughly review the facts of your case.

The other driver’s insurance company promised to pay my medical bills.  Will they?

Not until there is a settlement and maybe not even then.  The responsible driver’s insurance company will not pay for your medical treatment before there is a settlement.   Even if they promise to pay your bills, after you finish treating they may argue that your treatment was not reasonable and necessary leaving you stuck for the bill.  This is one reason why it is important to hire an experienced personal injury attorney to guide you from the beginning of your claim.

When should I call an attorney?

Right after the accident.  Even if you are on good terms with the responsible driver’s insurance company, you need to know what your rights are from the beginning so that you know how to protect them.

Can I use a paralegal instead of an attorney to represent me?

Practicing law without a license is a crime and you should never consult someone who is not a licensed attorney.

By hiring an attorney who is admitted to the bar, you are assured that he or she has the basic legal education that the State requires to practice law.  You are also assured that your attorney is taking a minimum of three hours of ethics courses per year.

By hiring an experienced attorney, you know that your representative knows how to anticipate and prevent problems that an unlicensed paralegal has never seen because he or she doesn’t have litigation experience. 

Attorneys who belong to the Alaska Association for Justice have the support of other attorneys practicing in the same area.  Paralegals do not have this support system.

Finally, paralegals are not regulated.  If you have a problem with an attorney, you can file a complaint with the Alaska Bar Association.  If you have a problem with a paralegal, you’re out of luck.
